1. Acceptance of Terms

By accessing or using LabelRight ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

LabelRight is an automated FDA nutrition label compliance checking tool. You upload nutrition label images, and our system extracts label data and checks it against 54 rules from 21 CFR Part 101. Results are provided as compliance reports.

3. Important Disclaimer

LabelRight is an automated screening tool, not a substitute for professional regulatory compliance review. Reports generated by LabelRight are for informational purposes only and do not constitute legal or regulatory advice.

You should always have your nutrition labels reviewed by a qualified regulatory compliance professional before production. LabelRight does not guarantee that labels passing all checks are fully FDA-compliant, as regulations may change and edge cases may exist beyond our rule set.

4. Account Responsibilities

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• You must notify us immediately of any unauthorized access

5. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, or violates third-party rights
• Attempt to reverse-engineer, scrape, or abuse the Service
• Circumvent usage limits or rate limiting
• Use the Service to compete directly with LabelRight
• Interfere with the operation or security of the Service

6. Pricing & Billing

• Scanning is free and unlimited for all accounts
• Full compliance reports can be purchased for a one-time fee per label
• Your first full report is free
• Product monitoring subscriptions are billed monthly or annually through Polar
• You can cancel monitoring subscriptions at any time
• Report purchases are non-refundable once the report has been accessed

7. Intellectual Property

You retain ownership of all label images you upload. Compliance reports generated by the Service are licensed to you for your use. The LabelRight service, including its rules engine, UI, and branding, is our intellectual property.

8. Limitation of Liability

To the maximum extent permitted by law, LabelRight shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect service availability. We will make reasonable efforts to notify users of planned downtime in advance.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may close your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify registered users of material changes via email.
